In my previous life as an Electronics Design Engineer I invented a few things and applied for patents on the ideas. 2 of these got to the Patent Pending stage. I didn't follow up on them since I left the large corporation that I was working for.

Now I think I have invented a technique to use in software that I am planning to maybe apply for a patent. It is related to making money online so it has big commercial potential. Normally I am against software patents but my one is only of interest to marketing people so I don't have a problem patenting it. The patent application will fully reveal the techniques involved so small timers can easily copy it and file share etc. But if I kept it secret then many people may never know about it. Also, I don't need any help from the open source community to develop it since it is fairly simple and I think I have it nailed.

To apply for a patent you need to describe your invention in words with diagrams. Last time I did it, I used a patent attorney that re-drew my CAD diagrams in pencil which I think is lame. So the patent application looks like something from the 1800's like inventing the ships compass. But hopefully we have moved on now.

Then the minions at the patent office check that your idea is "NEW" like nobody thought of it before i.e. there is nothing anywhere describing the same idea. When I say idea, I mean the same kind of widget.

It is more of a legal process than anything else and I love to bypass the legal-eagle fee-earning suits whenever I can, so I will try and do it all myself.

After doing some searches I think it may be difficult to explain the Newness of my Invention in the context of many similar ideas and the whole process would delay the launch of the product so I think I will avoid wasting my time applying for a patent on this.

Ah, well that's too bad... if you were going to go through all of the trouble of getting a patent, were you planning on selling the software/widget?

I am going to sell the Website optimization software. My rival charges $300 and I think my one is better.
